版权的核心是平衡各方利益。在开放出版背景下,学术期刊的良好版权工作实践需要兼顾作者和作品传播者的利益,才能长效促进开放科学弥补传统封闭科学系统的不足,以推动创新和变革。本文聚焦开放科学中出版方的版权实践以及作者的态度,在厘清版权、版权许可和出版协议三个概念及相关关系的基础上,从作者与出版方共生视角分析全球当前的版权实践及作者对版权问题的态度,并从出版方、作者和基金资助者角度提出版权实践优化建议,以为我国开放获取期刊进一步完善版权政策提供启示和参考。

Abstract

In the context of open access (OA) publishing, copyright issues face new complexities, such as the coexistence of OA and copyright transfer, the diversity of Creative Commons (CC) license types, and the potential for authors to have signed exclusive agreements with publishers. These challenges pose significant obstacles to the further healthy development of OA publishing. Good copyright practices in academic journals need to balance the interests of both authors and disseminators of the work in order to effectively promote open science and address the shortcomings of traditional closed scientific systems, thus fostering innovation and transformation. This paper aims to provide a comprehensive perspective on good copyright practices by considering the viewpoints of both publishers and authors. This paper first reviews the key concepts related to copyright, copyright licensing, and publishing agreements, then explores the various copyright models used in OA publishing, particularly focusing on the application of CC licenses. Additionally, it examines the current status of copyright licensing in domestic and international OA journals, especially those indexed in the Directory of Open Access Journals (DOAJ), major international OA publishers, and Chinese Academy of Sciences journals funded by the China Science and Technology Journal Excellence Action Plan. The analysis reveals that the CC BY license, which allows users to distribute, remix, and build upon the work as long as they attribute the original author, is the most commonly used copyright license in the DOAJ database. However, the copyright policies of different publishers vary significantly. Established publishers tend to adopt more restrictive licenses that limit how the work can be used, while emerging publishers are more likely to adopt open licenses that allow greater freedom for usage and redistribution. This paper specifically investigates authors' attitudes towards copyright licensing and discusses the potential impact of these attitudes on copyright policies. According to the survey conducted, nearly 80% of authors are concerned about copyright issues, but only 30% believe that copyright policies influence their choice of journal. Authors generally show a tolerant attitude towards the use of their work for academic and educational purposes, but are more cautious regarding its use for commercial purposes. The survey further highlights a limited awareness of Creative Commons licensing tools among authors, with 20% indicating no understanding of them. Finally, based on the data analysis and survey results, this paper concludes that journals should strike a balance between the interests of all stakeholders and optimize copyright management. Moreover, funding agencies and administrative bodies should leverage their resources to implement policy requirements, provide training, and facilitate the broader adoption of best practices in copyright management. Only through collaborative efforts from all stakeholders can the long-term success and sustainability of OA publishing be ensured, promoting an environment that supports both academic freedom and innovation.
